Weywebs Terms of Service

1. Introduction
 
These Terms of Service govern all website design, website development, and graphic design services provided by Weywebs. By engaging our services, the client agrees to be bound by these terms.
 
2. Service Engagement
 
All projects undertaken by Weywebs begin after confirmation of the project scope, mutual agreement, and receipt of the required deposit.
 
3. Payments and Deposits
 
Clients are encouraged to pay a 30% non-refundable deposit before the commencement of any project.
The remaining balance is payable upon project completion and before final delivery, website launch, or handover of files, unless otherwise agreed in writing.
 
4. Project Scope and Revisions
 
The project scope will be clearly defined prior to commencement.
Reasonable revisions within the agreed scope are included. Requests outside the original scope may result in additional charges and revised timelines.
 
5. Client Responsibilities
 
Clients are responsible for providing all required content, images, branding materials, and approvals in a timely manner.
Delays in providing information or feedback may affect delivery timelines and are not the responsibility of Weywebs.
 
6. Project Timelines
 
Estimated timelines are provided in good faith. Timelines may be adjusted due to delayed client feedback, scope changes, or unforeseen technical issues.
 
7. Approval and Completion
 
A project is considered complete once the client approves the final work or once it has been delivered in accordance with the agreed scope.
If the client does not respond within a reasonable time, the project may be deemed approved.
 
8. Intellectual Property and Copyright
 
Upon full payment, all intellectual property rights and copyrights of the completed project are transferred to the client.
Weywebs retains the right to display completed projects in its portfolio, website, and marketing materials unless the client requests otherwise in writing.
 
9. Third-Party Services
 
Weywebs may utilize third-party services such as hosting providers, plugins, fonts, or APIs.
Any associated licensing, subscription, or renewal fees are the responsibility of the client unless explicitly stated.
 
10. Content Responsibility
 
Clients warrant that all materials supplied to Weywebs are lawful and do not infringe on third-party rights.
Weywebs shall not be liable for content provided by the client.
 
11. Maintenance and Support
 
Website maintenance, updates, backups, and technical support are not included unless covered under a separate maintenance agreement.
 
12. Cancellations and Termination
 
If a project is cancelled after work has commenced, the deposit shall not be refunded.
Additional charges may apply depending on the amount of work completed at the time of cancellation.
 
13. Limitation of Liability
 
Weywebs shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business arising from the use of our services.
 
14. Confidentiality
 
Both Weywebs and the client agree to keep all confidential information shared during the project private unless disclosure is required by law.
 
15. Amendments
 
Weywebs reserves the right to update these Terms of Service at any time. Continued use of our services constitutes acceptance of the updated terms.
 
16. Governing Law
 
These Terms of Service shall be governed and interpreted in accordance with the laws of Kenya.
 
17. Acceptance
 
By ordering or using Weywebs services, the client confirms that they have read, understood, and agreed to these Terms of Service.

Weywebs Refund Policy

1. Deposits
 
All deposits paid to Weywebs are non-refundable. The deposit secures project scheduling, planning, and initial development work.
 
2. Project Cancellation
 
If a client cancels a project after work has commenced, no refund will be issued for the deposit or completed work.
If the client has paid more than the value of work completed, any excess amount may be refunded at Weywebs’ discretion.
 
3. Completed Projects
 
Once a project has been completed and approved, no refunds shall be issued.
 
4. Delays Caused by the Client
 
Refunds will not be granted for delays caused by the client, including late content submission, delayed feedback, or lack of communication.
 
5. Third-Party Costs
 
Payments made for third-party services such as domain registration, hosting, plugins, or licenses are non-refundable.
 
6. Exceptional Circumstances
 
Refunds may be considered only in exceptional cases where Weywebs is unable to deliver the agreed service, subject to management review.
 
7. Refund Processing
 
Approved refunds will be processed using the original payment method within a reasonable timeframe.
